A. Data Sharing and Privacy Policy

The privacy and data sharing policies disclose the practices for iwc.com.ph and apply only to the information collected thru this website. The following shall be strictly observed on matters pertaining to information collection, use and sharing, security procedures to protect misuse of information and the measures to correct inaccuracies in the information.

Data Gathering and Sharing
Description of Data. "Data" includes complete name of the planholder/member, their respective places of residence, birthdays, contact information, age, place of deployment, beneficiaries/dependent/s and all other data including corresponding places of residences and date of birth of sponsors/payers and relationship to dependents. From time to time, IWC may require medical history of the subject pursuant to the approval/non-approval of the coverage as further discussed in the plan certification;

License Grant to Use Data. The planholder/sponsor grants IWC a limited, non-exclusive, non-transferable, and revocable license to access, copy, and use the Data (the "Data") only in furtherance of the coverage or as required by law;

Standard of Care. IWC shall exercise at least the same degree of care as it uses with its own data and Confidential Information, but in no event less than reasonable care, to protect the Data from misuse and unauthorized access or disclosure.

Safeguards Around Data. IWC shall use appropriate safeguards to protect the Data from misuse and unauthorized access or disclosure, including maintaining adequate physical controls and password protections for any server or system on which the Data is stored, ensuring that Data is not stored on any mobile device (for example, a laptop or smartphone) or transmitted electronically unless encrypted, and taking any other measures reasonably necessary to prevent any use or disclosure of the Data other than as allowed under this agreement.

Agents and Subcontractors. IWC shall ensure that any affiliates or third parties including subcontractors, to whom it provides the Data agree to the same restrictions and conditions listed in this agreement.

No Modification of Data. IWC shall not copy, decompile, modify, reverse engineer, or create derivative works out of any of the Data.

Permitted Disclosure. IWC may disclose the Data only if and to the extent the planholder/buyer consents in writing to the disclosure and agree to abide and be bound by the provisions of this agreement.

Required Disclosure. If IWC is compelled by Law to disclose any Data, it shall provide planholder/buyer with prompt written notice so that planholder/buyer may seek a protective order or other appropriate remedy and/or waive compliance with the provisions of this agreement. IWC shall cooperate with the planholder/buyer to obtain a protective order or other appropriate remedy, and if the planholder/buyer cannot obtain a protective order or otherwise fail to quash the legal process requiring disclosure, IWC will disclose the requested Data only to the extent necessary to satisfy the request.

Unauthorized Disclosure Report. Within [three] days of IWC becoming aware of any unauthorized use or disclosure of the Data, IWC shall promptly report that unauthorized use or disclosure to planholder/member;

Confidentiality Obligations. The parties shall continue to be bound by the terms of the non-disclosure agreement between the parties;

Term. This agreement will commence on the Effective Date and continue as long as IWC retains the Data, unless terminated earlier;

Confidentiality.  CLIENT, including its employees, agents or representatives, shall not use or reproduce, directly or indirectly any Confidential Information for the benefit of any person, or disclose to anyone such Confidential Information without the written authorization of IWC, whether during or after the term of this Agreement, for as long as such information retains the characteristics of Confidential Information.

“Confidential Information” means any data or information, that is proprietary to IWC and not generally known to the public, whether in tangible or intangible form, whenever and however disclosed, including, without limitation, (i) personal information, treatments or operations undergone by its Members, (ii) trade secrets, confidential or secret formulae, special medical equipment and procedures, (iii) medical utilization reports, directly or indirectly useful in any aspect of the business of IWC, (iv) any vendor names, Member and supplier lists, (v) marketing strategies, plans, financial information, or projections, operations, sales estimates, business plans and performance results relating to the past, present or future business activities of IWC, (vi) all intellectual or other proprietary information or material of IWC; (vii) all forms of Confidential Information including, but not limited to, loose notes, diaries, memoranda, drawings, photographs, electronic storage and computer print outs; (viii) any other information that should reasonably be recognized as confidential information of IWC. All information which CLIENT acquires or becomes acquainted with during the period of this Agreement, whether developed by IWC or by others, which CLIENT has a reasonable basis to believe to be Confidential Information, or which is treated, designated and/or identified by IWC as being Confidential Information, shall be presumed to be Confidential Information. Confidential Information need not be novel, unique, patentable, copyrightable or constitute a trade secret in order to be designated Confidential Information.

IMPORTANT NOTICE. The Insurance Commission, with offices in Manila, Cebu and Davao, is the government office in charge of the enforcement of all laws related to HMO, pre-need and insurance and has supervision over HMO, pre-need and insurance companies and intermediaries. It is ready at all times to assist the general public in matters pertaining to HMO, pre-need and insurance.  

B. Security

When sensitive information is submitted via the IWC website, we take precaution on protecting said information both online and offline. Sensitive information such as credit card data are encrypted and transmitted via secure gateways;

Registration/Application Form
In order to use this website, a user must complete the registration/application form. During registration a user is required to give certain information (such as name and email address). This information is used to contact the member on the products/services on the site which the member may have expressed interest to.

Subscription
We request information from you on our subscriber form. To avail of our services, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your subscription. If we have trouble processing a subscription we'll use this information to contact you.

We use an outside shipping company to ship your cards, and a credit card processing company to bill subscribers. These companies do not retain, share, store or use personally identifiable information for any secondary purposes beyond filling your order.

While our trusted gateways provide encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.
